Please read these Terms of Service ("Terms") carefully before using the https://firstmade.com website operated by FirstMade ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

2. Services Provided

FirstMade provides digital services including but not limited to website development, AI automation, branding, and marketing. Project specifics, timelines, and deliverables will be outlined in a separate Statement of Work (SOW) or invoice.

3. Payment Terms

Unless otherwise agreed upon in writing, all projects require a non-refundable upfront deposit before work commences. The remaining balance is due upon project completion or at agreed milestones. We reserve the right to suspend services or withhold deliverables if payments are delayed.

4. Intellectual Property

Upon full and final payment, you will own the rights to the final deliverables provided by us. However, we retain the right to display the completed work in our portfolio, marketing materials, and case studies unless a specific Non-Disclosure Agreement (NDA) is signed.

5. Limitation of Liability

In no event shall FirstMade, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of West Bengal, India, without regard to its conflict of law provisions.
